TERMS AND CONDITIONS OF USE
These Terms and Conditions of Use ("Agreement") govern the use of Cloud Foodies ("Platform") by restaurant owners ("Restaurant Owner"). By accessing and using the Platform, the Restaurant Owner agrees to be bound by this Agreement.
Acceptance of Terms: The Restaurant Owner agrees to be bound by this Agreement by accessing and using the Platform. If the Restaurant Owner does not agree to the terms and conditions of this Agreement, they must immediately cease using the Platform.
Subscription and Fees: The Platform operates on a subscription-based model, which charges the Restaurant Owner on a monthly or annual basis for using the Platform. The fees are subject to change, and any changes will be communicated to the Restaurant Owner in advance. All payments made through the Platform will include applicable charges and fees at checkout.
Payment: The Restaurant Owner must provide accurate payment information and authorize the Platform to charge the subscription fees on a recurring basis. Failure to pay the subscription fees may result in the suspension or termination of the Restaurant Owner's account.
Use of Platform: The Restaurant Owner is solely responsible for the content that they upload to the Platform and must ensure that it complies with all applicable laws and regulations. The Restaurant Owner must also ensure that they do not use the Platform for any illegal or unauthorized purpose.
Intellectual Property: The Platform owns all intellectual property rights in the Platform, and the Restaurant Owner may not use or reproduce any part of the Platform without the prior written consent of the Platform.
Confidentiality: The Restaurant Owner agrees to keep all information received from the Platform confidential and not to disclose it to any third party without the prior written consent of the Platform.
Termination: The Platform may terminate the Restaurant Owner's account at any time, with or without cause. Upon termination, the Restaurant Owner will no longer have access to their account or any content uploaded to the Platform.
Disclaimer of Warranties: The Platform makes no warranties, express or implied, regarding the Platform, and the Restaurant Owner uses the Platform at their own risk.
Limitation of Liability: The Platform shall not be liable for any damages arising out of or in connection with the use of the Platform, including but not limited to direct, indirect, incidental, or consequential damages.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Platform is located.
Amendments: The Platform may amend this Agreement at any time, and any amendments will be communicated to the Restaurant Owner in advance.
This Agreement constitutes the entire agreement between the Restaurant Owner and the Platform and supersedes all prior agreements, representations, and understandings, whether written or oral, relating to the Platform. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
